Would you consider not sending any mails that aren't related to a
transaction? Alternatively, you could offer a checkbox during the
checkout process where people who are interested in this kind of
communication can opt in. If you do business in France, it's actually
mandatory to offer such a box, and the box must be unchecked by
default.
